Broadly speaking, theft is the act of intentionally taking someone else’s property. The charge encompasses two main elements: First, the person must have taken someone else’s property without his or her permission. Second, the person accused must intend to deprive the owner of the property permanently. Identifying this intent can be challenging.
Additionally, there are two main types of theft: theft of services and theft of property. In both cases, the person receives something for free, without intention of paying.
In a theft case, the main questions are the type of property and the value stolen. In Tennessee, there are five categories of theft, which include misdemeanors and felonies:
Theft value of $500 or less. Punishable by up to $2,500 in fines and one year in jail
Theft value of $500-$1,000. Punishable by up to $3,000 in fines and six years in prison
Theft value of $1,000-$10,000. Punishable by up to $5,000 in fines and 12 years in prison
Theft value of $10,000-$60,000. Punishable by up to $10,000 in fines and 15 years in prison
Theft value of more than $60,000. Punishable by up to $25,000 in fines and 30 years in prison
