Military service members experience many personal and professional situations that can place significant stress on them and their family members. Long hours and being away from home for extended periods can contribute to a breakdown of the marriage.
Consequently, being in the armed forces can create unique legal situations that require the help of an experienced family law attorney who can provide solid legal representation. No one likes dealing with emotionally challenging family law matters that impact their lives and military careers. However, when legal issues arise, hiring an attorney who understands what it takes to get results is always in one’s best interests.

What are Considered Family Law Cases?
Family law cases revolve around issues that deal with close personal relationships and typically include matters related to:
- Divorce
- Child custody
- Child support
- Property division
- Paternity
- Domestic violence
Dealing with the legal complexities involved in family law cases can be even more challenging for active-duty military personnel. Take a divorce case, for example; a non-military spouse may be entitled to a portion of the service member’s military retirement. Military retirement benefits and deciding how others should be handled can lead to even more contention in an upsetting situation. In other instances, military parents often must deal with legal issues related to child support and visitation; long deployments can further complicate matters.
Our attorneys understand this is likely a distressing time for you and your family. Therefore, our entire legal team is dedicated to providing you with the support you need to overcome this difficult time.
If you are considering hiring a family law attorney, contact the Law Office of Hibbeler & Associates today to schedule a free initial consultation. A qualified legal team member will gladly sit down with you to answer your questions.
Why Do I Need to Hire a Civilian Family Lawyer if I Am in the Military?
Most family law cases can be emotionally challenging regardless of whether the legal proceedings have a military component. However, active-duty service members have the added complexities of military retirement benefits and other issues that require the help of a family law attorney.
Although service members can obtain legal counseling through the military, a civilian attorney can have the skills and experience to navigate complex issues, especially if the couple has significant assets. An experienced civilian lawyer who handles military divorces will also have experience with the Uniformed Services Former Spouses’ Protection Act (USFSPA), which provides guidelines regarding how military retirement benefits should be divided among non-military spouses. The USFSPA also plays a large part in determining child support payments.
Our Fort Campbell lawyers offer compassionate representation in all aspects of family law matters, including child custody or support payments that are often complicated by long deployments. The Law Office of Hibbeler & Associates recognizes that service members often have to have special considerations due to their military service and will fight to protect their interests.
How Does the Servicemembers Civil Rights Act Protect Military Personnel Going Through a Divorce?
The Servicemembers Civil Rights Act (SCRA) protects military personnel who are dealing with divorce or other family law issues by allowing them to request a postponement if their active duty service impedes their ability to participate actively in legal proceedings.
The SCRA also protects service members by stopping potential default judgments that may occur because they cannot attend scheduled hearings. Military personnel can have hearings or other legal proceedings delayed for at least 90 days if necessary.
Some of the legal requirements related to obtaining a stay of legal proceedings include:
- The application must be in writing and state how the individual’s military service prohibits their ability to be present and give a date for when they can appear
- The application also includes written communication from the individual’s command and states that leave is not possible and how their military service prevents them from being present
The SCRA protects service members by imposing a 90-day stay and, if necessary, granting them an additional stay of proceedings.
If you have a family law court date that you cannot attend due to your military service, contact our law office to schedule a meeting with an attorney to assist you with your legal needs.
